Planning Board hearing set on site plan and change of use for former Truetech building, where shooting range and gun sales are planned – RiverheadLOCAL

The Riverhead Planning Board will hear from the public Thursday on a proposed site plan and change-of-use application for the former Truetech building, which is set to house a firearms facility, HVAC supply warehouse and distribution operation, and offices.

The public hearing is on the agenda for the 6 p.m. meeting of the board and residents are able to comment in person and online through Zoom.

Applicant Signature Partners is seeking site plan approval to perform façade updates, site improvements including parking, landscaping, lighting, and drainage upgrades, as well as to change the use of the existing vacant 736,100 sq. ft. commercial building located at 680 Elton Street in Riverhead to indoor recreation. The property is within the Commercial Residential Campus (CRC) zoning use district, which allows indoor sports and recreation facility and office uses as of right.

The applicant in December obtained a special exception from the Riverhead Zoning Board of Appeals for the warehousing use that allows the applicant to replace one pre-existing nonconforming warehouse use with another nonconforming use, Riverhead Planner Greg Bergman told the Planning Board during a presentation to board members in April.

The 73,100-square-foot former manufacturing and warehouse building is owned by Luxfer Magtech, according to county land records available online. The building has been vacant since early 2018.

Site plan and change-of-use approvals are required for it to open, Bergman said in an interview Tuesday. 

There may be a conflict with the site’s existing zoning and the retail gun sales proposed there. The CRC zoning use district lists 15 principal uses allowed as-of-right. “Indoor sports and recreation” was added to that list in 2006. The indoor shooting range is an indoor sports and recreation use, according to town officials.

The CRC zoning code specifically allows only two accessory uses — or a use that supplements an allowed principal use. The two accessory uses spelled out in the CRC code are “home occupations” and “drive-through windows for banks and pharmacies.”

However the code also states accessory uses that are not listed there “shall include those uses customarily incidental to any of the above permitted uses” when located on the same lot. Bergman said the “customarily incidental” language could be interpreted to mean a retail gun shop is “customarily incidental” to the shooting range and therefore is an allowed accessory use.

Bergman said the Planning Board can pursue an opinion from the Zoning Board of Appeals on whether retail sales is a “customarily incidental”accessory use to a shooting range if planning board members feel it needs clarification. Building and Planning Administrator Jefferson Murphree can also, as the town’s zoning officer, make a determination, Bergman said.

However the Planning Board already issued a determination of non-significance (a “negative declaration”) under the State Environmental Quality Review Act and its resolution also makes the related finding that “The proposed uses of the building is [sic] consistent with current zoning requirements.” 

The proposed tenants for the space include a firearm range and store operated by Niosi Firearms LLC, a licensed firearms dealer formerly located at Gabreski Airport in Westhampton Beach. Anthony Niosi, a principal in the company, has been criticized by community members recently for two interactions.
